Payment Terms

Fees and Pricing - All service fees are based on the scope of work agreed upon at the time of booking. Prices may vary depending on pool size, condition, accessibility, chemical requirements, and equipment status. Estimates are not guarantees and may be adjusted if unforeseen conditions arise.

Payment Due - Payment is due upon completion of services unless otherwise agreed in writing. For recurring service plans, payment may be billed weekly, bi‑weekly, or monthly according to the selected plan. Failure to remit payment may result in service suspension.

Late or Failed Payments - Late payments may be subject to administrative fees or interest as permitted by applicable law. Returned or failed payments may incur additional processing fees.

Additional Services - Services requested outside of the agreed service plan (including but not limited to excessive debris removal, algae remediation, or emergency visits) will be billed separately. Customer approval may be obtained verbally or electronically prior to completion.

Liability and Risk Allocation

No Guaranteed Results - Pool conditions are influenced by factors beyond our control, including weather, environmental debris, water source quality, bather load, and the condition of existing equipment. Aqua Shield Pools does not guarantee specific water clarity, chemical readings, or aesthetic outcomes.

Pre‑Existing or Hidden Condition

Aqua Shield Pools is not responsible for damage resulting from pre‑existing, hidden, or undisclosed conditions, including but not limited to:

Aging or cracked pool surfaces
Faulty or outdated plumbing or electrical systems
Worn liners, tiles, seals, or fittings
Malfunctioning or obsolete equipment

Chemical Use Disclaimer - Customers acknowledge that pool maintenance requires the use of chemicals that carry inherent risks. Aqua Shield Pools is not liable for damage caused by chemical reactions resulting from improper prior water chemistry, undisclosed conditions, manufacturer defects, or customer interference with water balance between service visits.

Limitation of Liability - To the fullest extent permitted by Ontario law, Aqua Shield Pools’ liability for any loss, damage, or claim arising from services provided shall be limited to the amount paid for the specific service visit giving rise to the claim. Under no circumstances shall Aqua Shield Pools be liable for indirect, incidental, or consequential damages. This limitation does not apply where prohibited by law.

Customer Responsibilities - Customers agree to provide safe, unobstructed access to the pool and equipment, maintain appropriate water levels, secure pets, and disclose any known hazards or equipment issues. Aqua Shield Pools reserves the right to suspend or refuse service where conditions are unsafe.

Aqua Shield Pools reserves the right to update or modify this Privacy Policy at any time. Changes will be posted on this page with an updated effective date.

Governing Law

These Payment and Liability Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict‑of‑law principles.

Compliance Note - Nothing in these Terms limits or excludes consumer rights that cannot be waived under the Ontario Consumer Protection Act, 2002. Any provision found to be unenforceable will be severed without affecting the remaining terms.
